After about two hours of argument in St. Mary Catholic Parish v. Roy, the Court's conservative majority appeared likely to rule for Catholic preschools excluded from Colorado's universal preschool program, CBS News reported. Justice Amy Coney Barrett asked how Colorado could impose a condition it knows religious schools cannot accept, and Justice Brett Kavanaugh noted that more than 2,000 preschools take part in the program while only 34 are overseen by the Archdiocese of Denver. Justices Kagan, Sotomayor and Jackson questioned whether the schools want a "special" rule.
