Ninth Circuit, 6-5, lets Trump administration ask states to set aside suspected noncitizen ballots

The Ninth Circuit Court of Appeals voted 6-5 on Tuesday to reinstate a stay, allowing federal officials to resume asking state election administrators to segregate ballots suspected of being cast by noncitizens, Fox News reported, citing SCOTUS Wire. The order does not require states to comply and does not establish that any voters are noncitizens. Chief Judge Mary Murguia was among five dissenters, warning election officials could face conflicting legal obligations.
