8th Circuit blocks Minnesota AI ‘nudification’ ban for now in xAI suit

Elon Musk’s xAI on Friday persuaded the 8th U.S. Circuit Court of Appeals to put Minnesota’s first-in-the-nation ban on AI-generated fake nude images on hold while the company pursues a lawsuit alleging the law is unconstitutional, Reuters reported. The state’s anti-“nudification” law, effective Aug. 1, bars website operators and software developers from allowing users to create realistic intimate images of an identifiable person not shown in the original photo; a lower-court judge had rejected xAI’s earlier bid for an injunction. xAI says the measure restricts free speech and that Grok Imagine includes rigorous protections against nudified or sexualized images of real people; Minnesota has argued the law targets child sexual abuse material generated by AI tools.
