In a miscellaneous order dated Thursday, Oct. 1, the Supreme Court granted certiorari in Missionaries of St. John, Inc. v. Frederic (No. 25-1131), limited to Question 1, along with Marschner v. Marschner and Rhoney v. Barbosa da Cunha, according to the Court’s order list. First Liberty Institute, which represents the Missionaries of St. John the Baptist, said the Kentucky Supreme Court had blocked a modest Marian grotto for prayer on church property in Park Hills after neighbors objected, and that the justices will clarify Religious Land Use and Institutionalized Persons Act standards; an oral-argument date has not been set. Separately, SCOTUSblog previewed Monday’s argument in Suncor Energy Inc. v. County Commissioners of Boulder County on whether state climate-liability suits against energy companies may proceed; Justice Alito has recused, raising the possibility of a 4-4 tie.
