Update: Alito still out of Suncor climate case; arguments Oct. 5
Justice Samuel Alito will not participate in Suncor Energy (U.S.A.), Inc. v. County Commissioners of Boulder County, No. 25-170, after Clerk Scott S. Harris wrote counsel Monday that Alito “has determined that he will not continue to participate,” according to the Court’s letter and SCOTUSblog. Oral argument remains set for Monday, Oct. 5 — the first day of the 2026–27 term — on whether federal law precludes state tort suits seeking damages from oil companies for alleged climate harms. Separately, as of this morning’s check, the Court had not issued a new order on the administration’s emergency stay request in Department of Homeland Security v. D.V.D. over third-country removals after immigrants filed their opposition Monday.
