The Supreme Court will hear argument Monday, Nov. 9, in Nielsen v. Watanabe, on whether a Hawaii federal inmate can sue a prison paramedic for money damages under the 1971 Bivens decision over allegedly denied care for a fractured coccyx, SCOTUSblog reported. The paramedic asks the justices to throw out the claim and even overrule Bivens; Solicitor General D. John Sauer backs dismissing the claim but says the Court should not reconsider Bivens in this case. The Court also hears Hoffmann v. WBI Energy Transmission, on pipeline eminent-domain compensation, Monday and releases orders at 9:30 a.m. ET, per the SCOTUSblog calendar.
