Supreme Court takes up Asian-American parents' school admissions challenge and the 1868 federal ban on home distilling

The Supreme Court agreed Monday to hear Association for Education Fairness v. Montgomery County Board of Education, in which mostly Asian-American parents argue that a Maryland county's lottery-based magnet-school admissions policy, though race-neutral on its face, was meant to reduce the number of Asian-American students, SCOTUSblog reported; the Court limited review to whether challengers must show an aggregate disparate impact. It also granted Department of Justice v. McNutt, on whether an 1868 federal law banning home distilleries, with penalties of up to $10,000 in fines and five years in prison, is a valid use of Congress's taxing power; the 5th Circuit struck the ban down and the 6th Circuit upheld it. Both cases are likely to be argued early next year.
