No new weekend orders; term opens Monday with Suncor climate liability and veterans case

The Supreme Court’s October Term 2026 session begins Monday, Oct. 5, according to the Court’s monthly argument calendar. First up is Suncor Energy Inc. v. County Commissioners of Boulder County (No. 25-170), on whether federal law precludes state-law climate-damages claims against energy companies and whether the Court has jurisdiction to hear the case; SCOTUSblog lists argument that day, and a Sept. 28 clerk’s letter notes Justice Samuel Alito will not participate. Also Monday: Johnson v. United States Congress, on whether a federal district court may hear a constitutional challenge to a law limiting disability benefits for certain incarcerated veterans.
