The Supreme Court heard argument Wednesday in Guerrero v. Johnson (No. 25-1003), on whether a claim relies on a "previously unavailable" new constitutional rule when the prisoner could have raised it in an earlier federal habeas petition, SCOTUSblog reported. Texas Solicitor General William R. Peterson argued for the state, joined by Emily M. Ferguson for the United States, and Jeremy Schepers argued for Texas death-row prisoner Dexter Johnson.
